Petitioner prays for bail in connection with Belsand P.S.Case No. 110 of 2017 registered for the offences punishable under Sections 302/34 of the Indian Penal Code. Allegation against the petitioner is that when his wife informed him about commission of rape by his friends upon her, he told her to allow them to commit such thing and they set her on fire also.
Submission of learned counsel for the petitioner is that FIR itself shows that he was not present at the place of occurrence and her allegation is against co-accused persons and moreover he is in custody since 19.3.2018.
Heard learned APP also, who has opposed the prayer for
Patna High Court Cr.Misc. No.46767 of 2018 (2) dt.18-09-2018 2/2 bail.
Having heard both sides and in the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner.
Hence, this application is dismissed.
