Petitioners apprehend arrest in a case registered for the offences punishable under Sections 323, 341, 379, 504/34 and other allied sections of Indian Penal Code. As per prosecution case, these petitioners along with 4-5 unknown persons armed with deadly weapons entered into the house of the informant and began to abuse her. On protest, they tried to outrage her modesty. It is further alleged that petitioner No. 1 took away cash of about Rs. 50,000/-. Learned counsel appearing for the petitioners submits that petitioners are innocent. Both parties are co-villagers and
Patna High Court CR. MISC. No.69244 of 2022(3) dt.28-03-2023 2/2 petitioner No. 1 had given certain amount to the husband of the informant and upon demand, this false case has been lodged against these petitioners. Petitioners claim clean antecedent. Considering the aforesaid facts and circumstances, let the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Benipatti at Madhubani in Arer P. S. Case No. 40 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
