2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 30 (a) and 32(3) of the Bihar Prohibition and Excise (Amendment) Act.

3. The case of the prosecution is that a Scooty was chased and from that Scooty, two persons tried to flee away but one of them was apprehended. It is alleged that from the Scooty altogether 47.625 liters of foreign liquor were recovered.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in connection with the present case. Petitioner is nowhere related with the alleged liquor. He is simply a passer-by and was arrested by the police on the spot. Petitioner has no criminal

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Alamganj P.S. Case No. 777 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Spl. Judge, Excise Patna City.
