The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 147, 149, 188, 332, 333, 353, 504, 506, 427 and 201 of the Indian Penal Code and Section 30 (a) of the Bihar Excise Amendment Act, 2018.
Learned counsel for the petitioner submits that there is recovery of 900 ml. of English wine from the Dalan of the petitioner. There is no recovery from the conscious possession of the petitioner. The petitioner has no criminal antecedent. In the aforesaid facts and circumstances of the case, let the petitioner, above named, subject to deposit of Rs. 2,000/- in the Patna High Court Legal Service Committee, in the event of his arrest or surrender before the court below within a period of six weeks
Patna High Court CR. MISC. No.71917 of 2019(3) dt.19-11-2019 2/2 from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J. IInd-cum-Special Judge (Excise) at Buxar in connection with Koransarai P.S. Case No. 134 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. Subject to the further condition that the amount of cost of Rs. 2,000/- be deposited in favour of Patna High Court Legal Services Committee.
