The petitioner, who is in custody, seeks bail in connection with Kishanganj P.S. Case No.16 of 2018 registered for the offence punishable under Sections 304B and 34 of the Indian Penal Code.
Informant is the father of the deceased, who in his written statement has stated that marriage of her daughter was solemnized with petitioner in the year 2004 and soon thereafter she was subjected to torture for non-fulfillment of demand of dowry and on 07/08.01.2018 informant's daughter was found dead in the house.
It has been submitted on behalf of the learned
Patna High Court Cr.Misc. No.45218 of 2018(2) dt.01-08-2018 2/2 counsel for the petitioner that the deceased has committed suicide and the police also after investigation has submitted charge-sheet under Section 306 of Indian Penal Code as stated in paragraph No.10 of the petition. The cause of death as per postmortem report is Asphyxia due to hanging. Petitioner is in custody since 24.01.2018.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj in connection with Kishanganj P.S. Case No.16 of 2018.
