ANJANA MISHRA ORAL ORDER 06-08-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner being the husband has been in custody since 15.03.2018 in connection with Bairiya P.S. Case No. 117/2017 registered for the offences punishable under Sections304(B)/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that though there is no positive evidence, the petitioner has been suffering incarceration since 15.03.2018.

However, considering the entire facts and circumstances and that the petitioner is the husband who is morally responsible to take care of his wife, I am not inclined to grant regular bail to this petitioner.

It is advisable that the trial of the case be expedited so as to conclude within nine months.
