This is a petition for grant of regular bail in connection with Bihariganj P.S. Case No. 70 of 2017 for offences under Sections 447, 323, 324, 307, 379, 504 and 34 of the Indian Penal Code.

The petitioner has renewed the prayer for bail as earlier bail application was rejected by this court by order dated 20.12.2017 passed in Cr. Misc. No. 61254 of 2017 with an observation giving liberty to the petitioner to renew the prayer for bail after six months.

Learned counsel for the petitioner submits that the allegation against the petitioner is of giving a single Gadasa blow on the head and there was no repetition; in view of the

Patna High Court Cr.Misc. No.43162 of 2018(2) dt.01-08-2018 2/2 earlier observation the prayer for bail has been renewed. The petitioner is in custody since 12.10.2017.

Having considered the aforesaid facts and circumstances, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Bihariganj P.S. Case No. 70 of 2017 to the satisfaction of the Judicial Magistrate, 1st Class, Udakishunganj, Madhepura.
