JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-08-2018 Heard the parties. The petitioners seek anticipatory bail in connection with Bhagawanpur P.S.Case No. 207 of 2017, registered for offences punishable under Sections 147, 148, 149, 353, 323, 325, 307, 504, 506, 427, 332, 333 of the Indian Penal Code and Section 27 of the Arms Act.

As per F.I.R., allegation against the petitioners is that on the death of one accused, who was arrested in Bhagwanpur P.S.Case No. 202/2017, about 400 to 500 persons including the petitioners have blocked the road and when police reached there, they started pelting stones.

Submission of the learned counsel for the petitioners is that there is no any specific allegation has been attributed against

Patna High Court Cr.Misc. No.45695 of 2018 (2) dt.06-08-2018 2/2 the petitioners and the petitioners have no criminal antecedents. It is further submitted that other co-accused persons have been granted bail vide order dated 18.05.2018 passed in Cr. Misc. No. 22923 of 2018.

Learned A.P.P. opposes the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioners, above named on surrender or arrest within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Bhagwanpur P.S.Case No. 207 of 2017, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
