ANJANA MISHRA ORAL ORDER 21-08-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners are in custody since 14.03.2018 in connection with Chanpatia P.S. Case No. 34 of 2018 registered for the offences punishable under Sections 461/379 of the Indian Penal Code. Learned counsel for the petitioners submits that though he is not named in the First Information Report, but subsequently, on the basis of the confessional statement made before the police by a coaccused, the petitioner has been implicated in connection with the present case. It is further submitted that nothing has been recovered from the conscious possession of the petitioner and whatever was recovered, which are rice and battery were belonging to the petitioner and such articles have not been placed for T.I. Parade for its identification to confirm that they were the stolen articles. Learned counsel for the petitioner further submits that he may be extended the privilege of bail.

No.46801 of 2018 (2) dt.21-08-2018 2/2 Considering the aforementioned facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-5th, Bettiah, West Champaran, in connection with Chanpatia P.S. Case No. 34 of 2018.
