1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 506, 409, 467 and 420 of the Indian Penal Code.
3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is the Branch Manager of the ICICI Bank, Araria. It is further submitted that from perusal of the allegation as alleged in the FIR, it would manifest that the thrust of the allegation of committing cheating and criminal breach of trust is against Prakash Kumar Singh who was known to the informant and other Jivika Didis and after convincing them had even taken the cheque books and used to collect money from them for depositing in their loan

No.79047 of 2024(4) dt.04-04-2025 2/3 account but subsequently it was found that Prakash Kumar Singh was not depositing the amount which he was collecting regularly and by forging the signature of the informant and others money was fraudulently withdrawn by him from the bank account to the tune of Rs.2,10,000/-.
4. Learned counsel thus submits that petitioner being the Branch Manager has been falsely implicated in the instant case when thrust of the allegation is against Prakash Kumar Singh. It is further submitted that petitioner will not abscond rather will cooperate in the investigation to prove his innocence.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, let the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Araria P.S. Case No. 769 of 2023, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.

However, if the investigating officer of the case files an application before the learned trial court bringing to its notice that the petitioner despite giving assurance to this Court is not cooperating in the investigation, the learned trial court shall be at liberty to cancel the bail bonds of the petitioner.
