JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 01-02-2018 Heard the learned counsel for the petitioners as well as the learned A.P.P. for the State.
In this application for anticipatory bail the petitioners apprehend their arrest in connection with Chowk P.S. Case No. 22 of 2017 for the offences punishable under sections 341, 323, 504 and 307/34 of the I.P.C.
Allegedly, petitioner no.1 assaulted the informant on her abdomen having pregnancy of four months causing pain in her abdomen and when her husband came for rescue he was also assaulted by them with Thapi and further damaged the house hold articles.
Submission is of false implication and that both parties
Patna High Court Cr.Misc. No.63116 of 2017 (2) dt.01-02-2018 2/2 are gotias, good relation has prevailed between the parties and both parties have filed compromise petition, vide Annexure-2, no offence under section 307 of the I.P.C. is made out and as such the petitioners deserve sympathetic consideration. The learned A.P.P. fairly submits that good senses have prevailed between the parties.
In the facts and circumstances stated above, the petitioners, in case of their arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Sushant Ranjan, J.M, 1st Class, Patna City, Patna in connection with the aforementioned case, subject to the condition as laid down under section 438 (2) of the Cr.P.C.
