JUSTICE ARUN KUMAR ORAL ORDER 27-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 26.2.2018, seeks bail in Banka Katoria PS Case No. 93 of 2017 registered under Section 394 of the IPC, Section 27 of the Arms Act and Sections 3,4,5 of Explosive Substances Act.

The FIR was lodged with regard to committing robbery by some unknown miscreants in the jewelry shop of the informant. Learned Counsel for the petitioner submits that the FIR is against unknown and the petitioner has been made accused on the basis of disclosure of his name in the confessional statement made by Rajesh Yadav who was granted bail by a coordinate Bench of this Court vide Cr. Misc. No. 59307 of 2017, another co-accused too have been granted bail by other coordinate Benches of this Court and the petitioner has no criminal antecedent.

Having considered the said facts and circumstances, the petitioner, namely, Sriram Das @ Mukesh Das is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM I Banka in connection with Katoria PS Case No. 93 of 2017.
