Mr.Renu Kumari ====================================================== CORAM: HONOURABLE MR. JUSTICE MADHURESH PRASAD ORAL ORDER 19-12-2019 Heard learned Counsel for the petitioners and the learned APP for the State.

The petitioners seek bail in Tarari PS Case No. 123 of 2019, Excise Case No. 1394 of 2019 registered under Sections 30(a) (b)(c) of Bihar Prohibition and Excise Act.

Counsel for the petitioners submits that the petitioners have no concern with the 60 Liter Mahua and some utensils for preparing the same recovered from the river bank. It is upon disclosure made by those apprehended on the spot that they have been implicated in this case. There is no recovery from the petitioners. Petitioners are in custody since 9.8.2019 and in other case pending against them in Ghorari PS Case No. 192 of 2019 they are on bail.

Having regard to the aforesaid submissions the petitioner's prayer for bail is allowed.

Let the petitioner above named be released on bail on his furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of IVth

No.79947 of 2019(3) dt.19-12-2019 2/2 Additional Sessions Judge -cum- Special Judge, Excise, Bhojpur, Ara in Tarari PS Case No. 123 of 2019, Excise Case No. 1394 of 2019 on the following conditions:- (i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner. (ii) That the petitioner will be well represented on each date in the trial and if he fails to do so on two consecutive dates, his bail will be liable to the cancelled.
