Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offence under Sections 8,20(b)(ii)(c), 25 of N.D.P.S.Act, 1985. Earlier the prayer for bail of the petitioner was refused vide order dated 01.12.2021 passed in Cr. Misc. No. 29280 of 2021.

Vide order dated 07.12.2022 a report was called for with regard to the present status of the trial. Report of the learned Trial Court dated 23.12.2022 reveals that five witnesses have already been examined till 13.12.2022 and the case is still

Patna High Court CR. MISC. No.68388 of 2022(3) dt.18-01-2023 2/2 pending for other prosecution witnesses.

Considering the aforesaid facts, I am not inclined to enlarge the petitioner on bail in connection with N.D.P.S. Case No.26 of 2020 (arising out of Dholbazza (Kadwa) P.S.Case No. 84 of 2020) pending in the court of learned Addl. Sessions Judge 17th, Bhagalpur.

Prayer is refused.

However, the learned Trial Court is directed to expedite the trial.
