JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 20-03-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Kudhani (Fakuli O.P.) P.S. Case No. 455 of 2021, registered for the offences punishable under Sections 302, 201, 34 and 120(B) of the Indian Penal Code.

As per allegation, the son of the informant had love and affection with the daughter of Ram Swarth Chaudhary. At the occasion of Haldi and Matkor ceremony of daughter of Ram Swarth Chaudhary, the son of the informant was present there. He also took meals in the house of Ram Swarth Chaudhary. Thereafter, the accused persons committed his murder after putting rope around his neck.

Patna High Court CR. MISC. No.69769 of 2022(2) dt.20-03-2023 2/3 The learned counsel for the petitioner has submitted that petitioner is not the family members of Ram Swarth Chaudhary. He is not concerned with the occurrence and has falsely been implicated in this case. He has further submitted that son-in-law of Ram Swarth Chaudhary, has been granted regular bail and other four family members of Ram Swarth Chaudhary have also been granted anticipatory bail. He has also submitted that as a matter of fact, the deceased was in love and affection with Puja Kumari, the daughter of the informant, whose marriage was going to be solemnized and due to agony and mental pressure, he himself committed suicide. The petitioner is under custody since 14.08.2022.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-Ist Muzaffarpur, West in connection with Kudhani (Fakuli O.P.) P.S. Case No. 455 of 2021, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in the
