The petitioner is in custody since 06.04.2018 in connection with Maniyari P.S. Case No. 88 of 2018 for the offence registered under Sections 399, 402, 414, 120(b) of the Indian Penal Code and Section 25(1-b)a/26 (ii) and 35 of the Arms Act.
Learned counsel for the petitioner submits that though the allegation is of possession of three cartridges, the said recovery was not made from conscious possession of the petitioner. So far as the antecedents are concerned, leaned counsel for the petitioner submits that he was implicated in three other cases, in which, he is already in bail.
Patna High Court Cr.Misc. No.47030 of 2018 (2) dt.09-08-2018 Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzuffarpur in connection with Maniyari P.S. Case No. 88 of 2018.
