1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of anticipatory bail apprehending his arrest in connection with Ara Nawada P.S. Case no. 432 of 2025 registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

3. As per the prosecution case, 16.125 litres of liquor was recovered from a sack tied to the motorcycle of which the petitioner happens to be the registered owner.

4. Learned counsel for the petitioner submits that no incriminating article has been recovered either from his possession or from his motorcycle as alleged in the FIR. The so called place of recovery is an open place accessible to all. The petitioner has been falsely implicated in the case. He has no

5. The application for anticipatory bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegation against the petitioner in the F.I.R., the alleged place of recovery from the motorcycle being the parking place near a public tea stall together with the petitioner not having any antecedent under the Bihar Prohibition and Excise Act, 2016, it is directed that the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Ara Nawada P.S. Case no. 432 of 2025 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Judge-I, Bhojpur, Ara.
