2. The petitioners seek bail in a case registered for the offence punishable under Sections 126(2), 115, 118(1), 109, 352, 3(5) of the B.N.S, 2023. Later on, section 103(1) of the BNS was added.

3. The prosecution case in brief is that all the FIR named accused persons including petitioner and 3-4 unknown person having variously armed came at the door of informant and assaulted the informant, his son and other family members.

4. Learned counsel for the petitioners submits that specific accusation of assault is against co-accused Umesh Ray and Shankar Ray who are alleged to have assaulted the son of informant with iron rod on his head. So far as petitioners are concerned, no specific overt act has been attributed against these petitioners. Chargsheet has already been submitted. Petitioners claim clean antecedent and they are in custody since 10.06.2025.

5. Learned APP and learned counsel for informant vehemently oppose the prayer for bail.

Considering the facts and circumstances of the case, the petitioners above-named, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate VIth, Vaishali at Hajipur in connection with Bhagwanpur P.S. Case No. 327 of 2024.
