====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 26-11-2019 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner seeks regular bail in connection with Nawada (Town) P.S. Case No. 637 of 2019 registered under sections 366 IPC.

The allegation against the petitioner is that the petitioner kidnapped the daughter of the informant and sold her to some other persons after taking money.

Learned counsel appearing for the petitioner submits that the petitioner has falsely been implicated in this case. The victim girl was not happy with her first marriage and went to Kota with the petitioner where the daughter of the petitioner is married, there, the victim girl has entered into a marriage with another person Mahendra Rathour at Kota with whom she is

Learned counsel referred to Annexures 2 and 2/1, which are the affidavits sworn by the victim girl and the alleged husband of the victim girl Mahendra Rathour. Learned counsel further submits that under the influence of father the victim girl has made her statement under Section 164 Cr.PC in which she has stated that the petitioner has forcibly solemnized marriage with the victim girl.

After having heard learned counsel for the parties and taking into consideration the fact that the victim girl has sworn affidavit and has stated that she has got married with one Mahendra Rathour of Kota on her free will and the petitioner is in custody since 12.06.2019, therefore, I am inclined to grant regular bail to the petitioner.

Accordingly, the petitioner, above named, is directed to be released on bail upon furnishing bail bond of Rs. 20,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Nawada in connection with Nawada (Town) P.S.
