====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-06-2023 Heard learned counsels for the petitioner and the State.
Petitioner apprehends arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 337, 448 and 504 of the Indian Penal Code and Section 27 of the Arms Act.
It is alleged that on 19.01.2022, at about 4:00 pm, while the informant and his wife were in the house, this petitioner, along with other accused persons, armed with lathi, came at the door and abused the informant. On protest made by his wife, all of them started indiscriminate firing and as a result, wife of the informant sustained injury.
Learned counsel appearing for the petitioner submits that allegation of firing and causing injury to the wife of the
Patna High Court CR. MISC. No.70107 of 2022(3) dt.22-06-2023 2/2 informant is general and omnibus. He next submits that though there is allegation of causing fire arms injury but injury report shows that the injury is simple in nature and is caused by hard and blunt substance. There is also a counter case vide Harnaut P. S. Case No. 32 of 2022 against the informant and his wife. Considering the general and omnibus allegation and injury report, this anticipatory bail is allowed and it is ordered that the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda, Bihar Sharif in connection with Harnaut P. S. Case No. 31 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
