ANJANA MISHRA ORAL ORDER 29-08-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 31.05.2018 in connection with Baruraj P.S. Case No.114 of 2018 registered for the offence under Section 392 of the Indian Penal Code. Learned counsel for the petitioner submits that though not named in the F.I.R., the petitioner's name has surfaced on the basis of the confessional statement made before the police by co-accused Chitranjan Kumar Sah, which has no evidentiary value. It is not further submitted that no recovery has been made from the possession of the petitioner nor has he any criminal antecedents.

Considering the aforementioned facts and

Patna High Court Cr.Misc. No.46126 of 2018 (2) dt.29-08-2018 2/2 circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Miss. Priti Kumari, J.M., 1st Class, Muzaffarpur, in connection with Baruraj P.S. Case No.114 of 2018.
