This is an application for bail in connection with Palasi P.S. Case No. 256 of 2016 registered for the offences punishable under Sections 341, 323, 325, 307, 379 and 504/34 of the Indian Penal Code.

Allegation against the petitioner is of assault by iron rod causing grievous injury.

Submission of learned counsel for the petitioner is that there is case and counter case between the parties and from the side of petitioner also some persons have received injuries and petitioner is in custody for three months.

Heard learned APP also.

Having heard both sides and in the facts and

Patna High Court Cr.Misc. No.61705 of 2017 (3) dt.11-01-2018 2/2 circumstances of the case, I am not inclined to grant bail to the petitioner at this stage but once charge has been framed against the petitioner, learned trial court shall release the petitioner on bail to its own satisfaction on filing an undertaking by the petitioner that he will co-operate in trial and will appear in court as and when required by the trial court.

With the above observation, this application is disposed of.
