Petitioner prays for bail in connection with Banka P.S.Case No. 239 of 2018 registered for the offences punishable under Sections 341, 354B and 504 of the Indian Penal Code. Allegation against the petitioner is that he tried to outrage the modesty of informant when she had gone to attend call of nature.

Submission of learned counsel for the petitioner is that the informant is in habit of filing of such type of cases and earlier also she had filed a case against the petitioner and petitioner is in custody for more than five months.

Having heard both sides and in the facts and

Patna High Court Cr.Misc. No.46258 of 2018 (2) dt.13-09-2018 2/2 circumstances, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka, in connection with Banka P.S.Case No. 239 of 2018, subject to the that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and further condition is that petitioner will not in any way harass the informant in future, otherwise prosecution will be at liberty to move for cancellation of his bail bond in the court below itself.
