2. The petitioner is in custody since 14.05.2023 in connection with Sikti P.S. Case No. 144 of 2023 registered for the offence punishable under Sections 21(b) of the NDPS Act.

3. As per the prosecution case, 30 grams of smack has been recovered.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He further submits that nothing incriminating has been recovered from the possession of the petitioner. He next submits that the recovery has been made from the co-accused Chitra Kumar Rapal who named one Gaurav Kumar and Gaurav Kumar named the petitioner. The petitioner has no criminal antecedents.

5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (NDPS) Act, Araria, in connection with Sikti P.S. Case No. 144 of 2023.

7. The petitioner is directed to mark his attendance in K. Hat (Maranga) police station on 1st Sunday of every month.

8. It is made clear that any default in appearance in the aforesaid police station, as directed, would result in cancellation of bail bond of the petitioner.
