The petitioner seeks pre-arrest bail in connection with Saharsa (Sadar) P.S. Case No. 314 of 2019 registered under Sections 341, 323, 324, 307, 504 and 34 of the Indian Penal Code and 27 of the Arms Act.
The accusation is that while the informant, Vikesh Kumar, was in the way, then, he was called from behind to stop, in the meantime, six boys came on two motorcycles. This petitioner (Sintu) caught hold of his collar, thereafter, Vishal fired through pistol, but, the same was missed, then, Vishal caused injury through the butt and b arrel at his fore-head. Lalu caused injury through iron rod. Nazul Mian, Bunty and Vishal also caused injury through fists and slaps.
Submission is that while the petitioner is named in the
Patna High Court CR. MISC. No.64419 of 2019(2) dt.24-10-2019 2/2 first information report, but, only allegation is that he caught hold the informant. Petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Saharsa (Sadar) P.S. Case No. 314 of 2019 shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
