2. This appeal is preferred against the order dated passed in ABP No. 3755 of 2024 passed by the learned Exclusive Special Court, SC/ST, Patna arising out of Barh P.S. Case No. 641 of 2023 for the offence registered under Sections 341, 323, 307, 504/34 of the Indian Penal Code and under Section 27 of the Arms Act and under Section 3(1)(r)(s), 3(2)(v) of SC/ST Act.
3. As per the prosecution case, the appellant is said to have assaulted the police party.
4. It has been submitted by the learned counsel for the
Patna High Court CR. APP (SJ) No.4581 of 2024(3) dt.27-11-2025 2/2 appellant that the appellant is innocent and he has falsely been implicated in this case.
5. Learned counsel for the State and Informant have vehemently opposed the application of the appellant.
6. From the reading of the FIR, this Court is of the view that this is not a fit case for grant of anticipatory bail.
7. Accordingly, this appeal stands dismissed and the interim protection granted to the appellant vide order dated 11.11.2024, is hereby vacated.
8. The appellant is directed to surrender within four weeks from today failing which the Superintendent of Police, Patna will take all steps for arrest of the appellants.
9. Let a copy of this order be communicated to the Superintendent of Police, Patna through FAX for its compliance. (Sandeep Kumar, J) Vikas/- U
