The petitioner apprehends his arrest in connection with Bathnaha P.S. Case No. 67 of 2024, registered for the offences punishable u/s 8, 20(b)(ii)(B) of the N.D.P.S. Act. 3.

Allegedly, 17.5 kg of Ganja is said to have been recovered from a car in which the petitioner was sitting. 4.

It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case merely due to suspicion. No incriminating article has been recovered from his conscious physical possession. He has no concern with the seized Ganja or vehicle. He was not apprehended on the spot and his name transpired on the basis of disclosure made by the

Patna High Court CR. MISC. No.74436 of 2024(2) dt.28-10-2024 2/2 apprehended co-accused who was driving the said car. Petitioner has no criminal antecedent as mentioned in para 3 of the bail application.

Learned APP for the State opposed the prayer for bail. 6.

Considering the aforesaid facts and circumstances, nature of offence and the fact that the name of the petitioner is disclosed by the driver of the said car, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected. 7.

This application is accordingly dismissed.
