The petitioner is in custody since 01.01.2018 in connection with Baruraj P.S. Case No. 180 of 2017 for the offence registered under Section 395 of the Indian Penal Code. Learned counsel for the petitioner submits that though the petitioners are not named in the first information report but subsequently, on the basis of the confessional statement made before the police by co-accused Nathuni Sahni, the petitioner has bee implicated in the present case which has no evidentiary value. It is further submitted that no recovery was made from the conscious possession of the petitioner and he has no criminal history.
Patna High Court Cr.Misc. No.44488 of 2018 (2) dt.14-08-2018 Considering the aforesaid facts and circumstances of the case, and that the similarly situated co-accused person, namely, Raju Sahni has since been extended the privilege of bail vide order dated 14.06.2018 passed in Cr. Misc. No. 33361 of 2018, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Muzuffarpur in connection with Baruraj P.S. Case No. 180 of 2017.
