The petitioner seeks pre-arrest bail in connection with Adhaura P.S. Case No. 22 of 2019, pending in the Court of the Chief Judicial Magistrate, Kaimur at Bhabhua, registered under Sections 420, 467, 468, 471 and 120B of the Indian Penal Code. The accusation is that in course of vigilance enquiry in the light of the order, passed in C.W.J.C. No. 15459 of 2014 of Hon'ble High Court, Patna, the marks sheet of Intermediate of the petitioner, as submitted by the petitioner for appointment of primary teacher, was found fake and total number was shown as 731 while, on verification, it was found as 345. Having regard to the facts and circumstances of the case, I am not inclined to grant the privilege of pre-arrest bail to the petitioner. The prayer for pre-arrest bail is rejected. The petitioner is directed to surrender before the Court below and seek regular bail, which will be considered by the trial Court on its own merit without being prejudiced of this order.
