The petitioner is in custody since 12.06.2018 in connection with Chapra Town P.S. Case No.294 of 2018 registered for the offence under Sections 384, 506 and 307/34 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that the entire allegation is false and fabricated and the case has been engineered at the instance of inimical forces, who have tried to rope in the petitioner on false pretext. It is further submitted that though the petitioner is alleged to have fired, there is no injury as the informant has escaped unhurt and thus, no case
Patna High Court Cr.Misc. No.44467 of 2018 (2) dt.06-08-2018 2/2 under Section 307 I.P.C. is made out. It is further submitted that apart from the case as stated in paragraph 3, there is no other case against the petitioner. In the said case, the petitioner has already been extended the privilege of bail.
In view of the aforementioned facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Saran, Chapra, in connection with Chapra Town P.S. Case No.294 of 2018.
