The petitioner, in the present case, is seeking regular bail in connection with Banmankhi P.S. Case No 189 of 2017 registered for offences alleged under Sections 341, 342, 323, 364, 365, 379, 504, 506/34 of the Indian Penal Code. Learned counsel for the petitioner submits that from perusal of the F.I.R., itself it would appear that according to the informant he had friendship with the four named accused persons and one of them had taken him to the place of occurrence at Purnea, where 2-3 persons were already there, whose name, he could not disclose in the F.I.R.. The allegation is that he was being compelled to carry a bag with wine bottles and on denial, all of them assaulted him, confined in a room and snatched away

Patna High Court Cr.Misc. No.63745 of 2017 (2) dt.11-01-2018 his mobile and Rs. 9,000/- in cash. He further submits that petitioner is not named in the F.I.R. and his name has transpired only on the confessional statement of the named accused. It is further submitted that one of the named accused persons, namely, Raja Kumar @ Prince @ Raja Yadav has already been granted regular bail in Criminal Miscellaneous No. 58302 of 2017. Learned APP opposed the prayer for bail.

Considering the facts and circumstances, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in connection with Banmankhi P.S. Case No189 of 2017 subject to the conditions U/S 437(3) Cr.P.C. (Rajeev Ranjan Prasad, J) Arvind/sushma/- U T
