ANJANA MISHRA ORAL ORDER 10-08-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner has been in custody since 02.05.2018 in connection with Muzaffarpur Sadar P.S. Case No. 291/2018 registered for the offences punishable under Sections 420/414 of the Indian Penal Code.

Learned counsel for the petitioner submits that the entire allegation is false and fabricated and the recovery of several ATM cards from his possession alone cannot from the basis of any offence, unless and until they were used for withdrawing any amount from any particular account.

Learned counsel for the petitioner further submits that the Apache motorcycle which was alleged to have been recovered

Patna High Court Cr.Misc. No.44592 of 2018 (2) dt.10-08-2018 2/2 from the petitioner's possessions is, in fact, belonging to his aunt who had given him the same for the purpose of bringing medicine. It is thus, submitted that no offence under Sections 414 and 420 is made out as has been stated in the First Information Report. Learned counsel for the petitioner further submits that the petitioner has got no criminal antecedent.

In view of the aforementioned facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Muzaffarpur in connection with Muzaffarpur Sadar P.S. Case No. 291/2018.
