2. This is the 2nd attempt of the petitioner in connection with Bairgania P.S. Case No. 48 of 2011 registered for the offence under Section 394 of the Indian Penal Code.

3. Earlier the bail application of the petitioner was rejected on 17.02.2024 in Cr. Misc. No. 5867 of 2024 which reads as follows:- Heard learned counsel for the petitioner and learned APP for the State.

2. This application for grant of regular bail arises out of Bairgania P.S. Case No.48 of 2011 registered for the offence punishable under Section 394 of the Indian Penal Code.

3. The petitioner is accused of participating in the snatching of a motorcycle.

4. During investigation, materials

Patna High Court CR. MISC. No.73868 of 2024(8) dt.31-10-2025 2/2 have come to connect the petitioner with the crime. Earlier, the petitioner is also accused in a case of docoity and in another case of murder. He is in custody since 13.10.2023.

5. Considering the aforesaid facts, I am not inclined to grant the petitioner privilege of regular bail. Accordingly, this bail application is rejected. If there is no substantial progress in the trial, the petitioner may renew his prayer for bail.

4. The learned APP for the State submits that the I.O. of the case is the only witness who is to be examined and it is expected that he will appear in the Court below on the next date fixed.

5. In these circumstances, I am not inclined to grant regular bail to the petitioner. Accordingly, this application for regular bail is hereby rejected.
