JUSTICE ASHUTOSH KUMAR ORAL ORDER 19-11-2019 The petitioner seeks quashing of the order dated 23.09.2015 passed by the learned Judicial Magistrate, 1st Class, Patna in connection with in Sessions Trial No. 262 of 2016 arising out of Jakkanpur P.S. Case No. 220 of 2015 whereby cognizance has been taken under Sections 302, 201, 342, 323, 325, 307, 120B/34 of the Indian Penal Code.

Mr. Sanjay Kumar Giri, learned advocate for the petitioner, after some arguments, seeks permission to withdraw this petition in order to enable the petitioner to raise all the grounds at the appropriate stage of discharge, if such a petition has already not been filed and disposed of.

In that event the court shall look into the entire set of facts and shall pass a reasoned order in

Patna High Court CR. MISC. No.3048 of 2018(2) dt.19-11-2019 2/2 accordance with law without being prejudiced by the fact that the present petition has not been entertained. The petition stands dismissed as withdrawn.
