JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-10-2019 This is an application for grant of anticipatory bail in connection with Biraul P. S. Case No. 70 of 2013, disclosing offences under Sections 376 and 511 of IPC.

Earlier prayer for anticipatory bail of the petitioner was rejected, vide order dated 28.01.2014 passed in Criminal Misc. No. 34358 of 2013 on merit.

Submission of the learned counsel for the petitioner is that petitioner was juvenile at that time and as such, he has filed the present application.

Heard learned A.P.P. also.

Having heard both sides, in view of the fact that earlier prayer for anticipatory bail of the petitioner was rejected by the then a Co-ordinate Bench of this Court and there was no submission at that time that he was juvenile, I am not inclined to

Patna High Court CR. MISC. No.62791 of 2019(2) dt.15-10-2019 2/2 grant privilege of anticipatory bail to the petitioner. However, he may surrender before the learned court below and make prayer for regular bail, which shall be disposed of by the court below without being prejudiced by present order.
