JUSTICE ARUN KUMAR ORAL ORDER 26-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 16.2.2018 seeks bail in Kotwali PS Case No. 664 of 2017 registered under Sections 417, 418, 419, 420, 409, 467, 468, 120(B) of the IPC and Section 138 of N.I.Act.

The allegation in brief is that the informant came in contact with the petitioner's husband who asked him to be associated with him in the business of furniture and persuaded him to invest fifty lakh rupees, but the furniture was not supplied to him therefore he asked to return back the money, on which the petitioner's husband issued a cheque from his account which got dishonoured on presentation, earlier the petitioner had also undertaken the responsibility of supply of furniture.

Learned Counsel for the petitioner submits that taking into account entire allegation it appears that there is no allegation against the petitioner relating to transaction of any money from the informant rather that is specific against her husband, the petitioner is a lady and has been in custody since 16.2.2018.

No.44830 of 2018 (2) dt.26-07-2018 Having considered the said facts and circumstances, the petitioner, namely, Mithilesh Singh is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Patna in connection with Kotwali PS Case No. 664 of 2017.
