====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 08-10-2025 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

2. This application for grant of anticipatory bail arises out of Naubatpur Police Station Case No. 298 of 2025 disclosing offence under Sections 126(2), 115(2), 109, 75 303(2) and 3(5) of B.N.S., 2023.

3. The prosecution case, as per the First Information Report is that, on 20.05.2025, the petitioners along with others came to the house of the informant with weapons, started assaulting, due to which informant sustained injury on his head and daughter-in-law of the informant was admitted in AIIMS.

4. Learned Counsel for the petitioners submits that

Patna High Court CR. MISC. No.68658 of 2025(2) dt.08-10-2025 2/3 petitioners are full brother of the informant and there is dispute regarding partition between them. Learned counsel further submits that from mere perusal of the FIR, it is evident that there is general and omnibus allegation of assault by the petitioners on the informant and there is no specific allegation that daughter-in-law of the informant was also assaulted by the petitioners and others. The prosecution has not brought on record the injury sustained by the informant, however, from the impugned order, it appears that daughter-in-law of the informant has suffered injury near the forehead but the nature of injury has not been described as grievous. A Counter case has also been lodged by the side of the petitioner bearing Naubatpur P.S. Case No. 299 of 2025.

5. Having regard to the submissions made by the parties and taking into consideration the fact that both the parties are closely related, having partition dispute, case and counter case is there, I am inclined to grant the petitioners privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs.

Patna High Court CR. MISC. No.68658 of 2025(2) dt.08-10-2025 3/3 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Danapur, Patna/concerned Court in connection with Naubatpur Police Station Case No. 298 of 2025, subject to the condition laid down under Section 482 (2) of the B.N.S.S.
