This is a petition for grant of regular bail in connection with K. Hat (Maranga) P.S. Case No. 247 of 2018 for offences under Sections 307, 324 and 120B of the Indian Penal Code and 27 of the Arms Act.
Accusation is that one Parshanjeet Das, the brother of the petitioner, opened fire on the informant causing fire arm injury and thereafter while the the informant was going for treatment on the way the petitioner also made an attempt to stop his motorcycle.
Learned counsel for the petitioner submits that the allegation of causing fire arm injury is against his brother,
Patna High Court Cr.Misc. No.47282 of 2018(2) dt.02-08-2018 2/2 Parshanjeet Das, another accused. There is no allegation that the petitioner was also present at that time. The petitioner has been implicated because of being brother of Parshanjeet Das and while the informant was going for treatment the petitioner made an attempt to stop his motorcycle. However, the petitioner has no criminal antecedent.
Having considered the aforesaid facts and circumstances as there is no accusation against the petitioner of opening fire, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with K. Hat (Maranga) P.S. Case No. 247 of 2018 to the satisfaction of the Chief Judicial Magistrate, Purnea. (Arun Kumar, J) ShamshadSaurabh/- U T
