The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 147, 148, 149, 323, 324, 307, 356, 379, 325 of the Indian Penal Code. As per prosecution case, while the informant was returning his home, in the meantime, all accused persons including the petitioner intercepted him and order of this petitioner, they assaulted him by means of knife due to which he sustained injury. Thereafter, they looted 2,34,500/- cash along with mobile phones, ATM card, PAN card and other articles from him.
Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.68604 of 2022(2) dt.27-02-2023 2/3 petitioner is innocent and has committed no offence. He has falsely been implicated in this case. The alleged date of occurrence on 30.5.2022 but the FIR has been lodged in delay of four days on 3.6.2022. It is further submitted vide para 11 of the petition that relation between the petitioner and the informant was good and the petitioner also helped the informant in opening his shop. Before the alleged occurrence, informant left his PAN card, ATM card as well as cheque book. A statement has been made in para-3 of the petition that the petitioner has got no criminal antecedent. It is further submitted that the petitioner is languishing in judicial custody since 7.6.2022.
Learned APP appearing for the state has opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bettiah Muffasil P.S. Case No. 432 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned
