2. The petitioner seeks regular bail in connection with Sasaram (Nagar) P.S. Case No. 473 of 2023, registered for the offences punishable under Sections 25(1-B)a, 26 & 35 of the Arms Act.

3. As per the prosecution case, under the constructed house of the co-accused Vicky Kumar, under a godrej cloth, five country made pistol, two pieces magazine and 33 cartridges have been recovered.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He further submits that the petitioner was coming from his oil mill then he was arrested near the house of the accused

Patna High Court CR. MISC. No.71591 of 2023(4) dt.31-01-2024 2/2 Vicky Kumar and no incriminating articles have been recovered from the possession of the petitioner. He further submits that charge-sheet has already been submitted in this case against the petitioner and there is no chance of absconding or tampering with the evidence. He also submits that has no criminal antecedent and he is in jail custody since 05.06.2023.

5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

6. Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram or Concerned Court Below in connection with Sasaram (Nagar) P.S. Case No. 473 of 2023.
