Petitioner seeks bail in Gandhi Maidan P.S.Case No.167 of 2018 registered for the offences under Sections 302, 201, 120B of the I.P.C. and Section 27 of the Act.

Petitioner is not named in the F.I.R. His name transpired during course of investigation only on the basis of confessional statement of co-accused Amar Kumar.

Submission of the learned counsel for the petitioner is that from confessional statement of co-accused it is apparent that he has not participated in the occurrence. He is in custody since 31.5.2018.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be

Patna High Court Cr.Misc. No.46345 of 2018 (2) dt.13-09-2018 2/2 released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of A.C.J.M. VI, Patna, in Gandhi Maidan P.S. Case No.167 of 2018 subject to the conditions that (1) one of the bailors must be a local person having sufficient immovable property within the jurisdiction of the concerned court. (ii) the petitioner will not induce any witness or tamper with the evidence and the petitioner shall co-operate in the disposal of the trial and make himself available as and when required by the court, otherwise, his bail bond shall be cancelled.
