The petitioners seek bail in a case registered for the offence punishable under Sections 341, 302, 120 (B) of the Indian Penal Code.

Submission is that the informant who is mother of the deceased has alleged that her son had gone to his sasural and later on she received information that he was killed and, therefore, she went there and saw the dead body of his son and she suspected the hands of petitioners and FIR named persons. Learned counsel for the petitioners submit that the petitioner is in custody since 16.05.2019 and have got no

Patna High Court CR. MISC. No.66943 of 2019(2) dt.06-11-2019 2/2 criminal antecedent. The co-accused have been granted bail by the Co-ordinate Bench of this Hon'ble Court in Cr. Misc. No. 16239 of 2019 (A. Bail) dated 02.05.2019 and Cr. Misc. No. 49230 of 2019 dated 01.10.2019. Petitioner no. 1 is father-inlaw and petitioner no.2 is brother-in-law of the deceased. Learned counsel for the petitioners further submit that there is no eye-witness of the occurrence and only on the basis of suspicion have been made accused in this case. There is no allegation of tampering of witnesses alleged against the petitioners.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Motihari, East Champaran, in connection with Sugauli P.S. Case No. 365 of 2018.
