2. Petitioner seeks regular bail in connection with Harsidhi P. S. Case No. 296/2024 in a case registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 307, 448, 380, 504 and later on added Section 302 of the Indian Penal Code.
3. Allegedly on a protest made by the informant, while accused persons were indulged in cutting the Bamboo from her field, all the accused persons caught hold the informant and brutally assaulted. It is further alleged that when her family members came to her rescue, they have also been assaulted by the accused persons.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.68581 of 2025(2) dt.04-11-2025 2/2 petitioner is innocent and has been falsely implicated in this case. Allegation of assault is general and omnibus. There is no specific overt act against this petitioner. Similarly situated other co-accused persons have already been granted regular bail by a co-ordinate Bench of this Court vide order dated 18.01.2025 passed in Cr. Misc. No. 81824 of 2024. Petitioner claims clean antecedent and he is in custody since 18.05.2025.
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts and circumstances of the case, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., East Champaran, Motihari in connection with Harsidhi P. S. Case No. 296 of 2024.
