Petitioner, already in custody, seeks bail in connection with Chanan P.S. Case No.84 of 2014, registered under Sections 147, 148, 341, 323, 324, 337, 307, 504, 376 and 511 of the Indian Penal Code as well as under Section 27 of the Arms Act. Accusation is that all accused persons came armed and the petitioner shot from the point blank range at the face of the informant. It is also alleged that one Braj Kishore Yadav also tried to outrage the modesty of the wife of the informant and made an attempt of rape.

Learned counsel for the petitioner submits that there is land dispute between both sides and Title Suit No.34 of 2010 is sub-judice between both sides and except the tattooing and

No.48649 of 2018(2) dt.07-08-2018 2/2 blackening, there is no mark of pellets or injury of firearm and the allegation of outraging the modesty is not against the petitioner and that too is superfluous alleged due to land dispute. Having considered the aforesaid facts and circumstances, petitioner Ranjit Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, 1st, Lakhisarai in connection with Chanan P.S. Case No.84 of 2014.
