The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 147, 148, 149, 323, 324, 307, 353,, 427, 447, 448, 452, 379, 380, 120B, 504, 506, 193 of the Indian Penal Code and 3/4 of Damage to Public Property Act.
Allegation as per FIR is that police on information apprehended some accused persons and villagers assembled there and assaulted the police party in order to keep the accused persons free.
Learned counsel for the petitioners submits that the
Patna High Court CR. MISC. No. 66181 of 2019(2) dt.15-11-2019 2/2 petitioner no. 1 is named in the FIR and the petitioner no. 2 is not named in the FIR. The petitioners have no criminal antecedent. There is no specific allegation against the petitioners. The co-accused have been grant bail by the Coordinate Bench of this Hon'ble Court vide Cr. Misc. No.13843 of 2019 dated 06.03.2019, Cr. Misc No. 22634 of 2019 dated 11.04.2019 and Cr. Misc. No.29636 of 2019 dated 09.05.2019. In the aforesaid facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned I/c J.M.-5th, Sitamarhi, in connection with Kanhauli P.S. Case No. 162 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
