The petitioner seeks regular bail in connection with Siwan Town P.S. Case No. 421 of 2017, registered for the offences punishable under Section 365 of the Indian Penal Code and later on, Sections 364, 302, 201/34 of the Indian Penal Code was added.

The allegation in the present case is regarding the son of the informant having become traceless and subsequently, his dead body was found.

The learned counsel for the petitioner has submitted that the name of the petitioner has transpired in the present case on account of the confessional statement made by one Dhananjay Prasad @ Bhajju and the said Dhananjay Prasad @ Bhajju has

No.34313 of 2018(3) dt.23-07-2018 2/2 already been granted bail by a co-ordinate Bench of this Court by an order dated 05.04.2018 passed in Criminal Miscellaneous No. 13093 of 2018. It is further submitted that the petitioner is having a clean antecedent and he is languishing in custody since 22.08.2017.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail. Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial MagistrateVIII, Siwan in connection with Siwan Town P.S. Case No. 421 of 2017.
