The petitioners seek regular bail in connection with Gurua P.S. Case No. 62 of 2018, registered for the offences punishable under Sections 342, 323, 354(A), 354(B), 307, 504 and 506/34 of the Indian Penal Code.

The allegation is regarding the accused persons having beaten the informant and his son on the pretext that the son of the informant used to commit theft in the village on a regular basis.

The learned counsel for the petitioners submits that the allegation is false and the injury report would show that the informant and his son have received only simple injuries. It is

No.34316 of 2018(3) dt.23-07-2018 2/2 further submitted that as far as the Petitioner Nos. 2 and 3 are concerned, they are having a clean antecedent while the Petitioner No. 1 is an accused in another case in which he is on bail. The petitioners are said to be languishing in custody since 08.04.2018.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioners on regular bail. Accordingly, the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Sherghati at Gaya in connection with Gurua P.S. Case No. 62 of 2018.
