The petitioner seeks bail in a case for the offence registered under Section 366(A) of the IPC.

The prosecution story, in brief, is that on 27.06.2019 at about 10.00 A.M. the petitioner kidnapped the minor daughter of the informant. When he went to the house of petitioner, his father and mother abused and threatened the informant and his family members.

It has been submitted by learned counsel for the petitioner that the petitioner is languishing in custody since 03.07.2019. The petitioner has got no criminal antecedent. The petitioner has falsely been implicated in the present case. Charge sheet has been submitted in the present case. There is no

Patna High Court CR. MISC. No.64044 of 2019(2) dt.22-10-2019 2/2 allegation of tampering with the witnesses alleged against the petitioner. The victim has been examined under Section 164 of Cr. P.C. She has not supported the allegation made in the F.I.R. She has left her house out of her own will and got married with this petitioner.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Banka, in connection with Katoria P.S. Case No. 109/2019.
