JUSTICE BIRENDRA KUMAR ORAL ORDER 12-03-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner seeks bail in Beur P.S. Case No. 273 of 2016 registered for the offence punishable under Sections-304(B), 201/34 of the Indian Penal Code.

Since the death of wife of the petitioner occurred after eight years of her marriage, the presumption of dowry death is not attracted against the petitioner. There is no eye witness of the occurrence. The other accused persons have been granted bail by coordinate benches of this Court. The petitioner is in custody since 22-10-2016.

Considering the aforesaid facts, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs.

Patna High Court Cr.Misc. No.63206 of 2017 (3) dt.12-03-2018 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court below in connection with the aforesaid case.
