Petitioner seeks bail in a case registered for the offences punishable under Sections 406,420 and 120(b) of the Indian Penal Code.
The complainant had entered into an agreement to purchase property from co-accused Rajini Mishra through this petitioner, who was a middle man. Allegation is that consideration money was paid to the petitioner. However, sale deed was not executed. Submission of the learned counsel for the petitioner is that after receipt of consideration money from
Patna High Court Cr.Misc. No.45178 of 2018 (2) dt.02-08-2018 2/2 the complainant, the petitioner paid the same to Rajini Mishra in the presence of complainant and when Rajini Mishra started avoiding execution of sale deed, the petitioner lodged complaint case No.1515C of 2016 against Rajini Mishra.
Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Complaint Case No.53 of 2017, Tr. No.1827 of 2017, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
